Term of Use

These Terms of Use (the “Terms”) govern your participation in the private cultural experience tours (the “Services”) provided by Hiwadaya Co., Ltd. (“Hiwadaya,” “we,” “us,” or “our”). By applying to use the Services, you (“Customer”) agree to these Terms.

1. The Services

The Services consist of a “one group per day” exclusive private tour focusing on the traditional art of Hiwadabuki (cypress bark roofing), planned and operated by Hiwadaya.

2. Formation of Contract

  1. The Customer shall apply for the Services using the contact form on our website or by other methods designated by us.
  2. A contract for the Services is formed between the Customer and Hiwadaya at the time we confirm the details of the application and send a booking confirmation notice (e.g., via email) to the Customer.

3. Fees and Payment

  1. The fee for the Services shall be the amount indicated on our website.
  2. The Customer shall pay the fee by the due date and method (e.g., bank transfer, credit card) specified by Hiwadaya.

4. Cancellation Policy

The Services are a bespoke private tour, requiring the reservation of master artisans and facilities exclusively for your group for an entire day. Should the Customer cancel the reservation for personal reasons after the contract is formed, the following cancellation fees will apply:

  1. 14 days or more prior to the experience date: No charge
  2. 13 to 7 days prior to the experience date: 50% of the Service fee
  3. 6 days prior to, or on the day of the experience (including no-shows): 100% of the Service fee

5. Cancellation or Alteration by Hiwadaya

  1. We reserve the right to cancel or alter the Services in the following cases: (1) Natural disasters, extreme weather, transportation disruptions, or other events beyond our reasonable control. (2) Sudden illness of the artisan or other unavoidable circumstances making the provision of Services difficult. (3) When deemed necessary for the safety of the Customer.
  2. If we cancel the Services based on the preceding clause, we will refund the full fee received from the Customer. However, we are not liable for any other compensation (e.g., travel costs to Yamaguchi, accommodation fees).

6. Customer’s Responsibility

  1. The Customer must follow the instructions of our staff and artisans at all times, especially during the workshop, and act with consideration for their own safety.
  2. The Customer shall be liable for compensating Hiwadaya or any third party for damages caused to our facilities, equipment, or personnel due to the Customer’s willful misconduct or negligence.
  3. The Customer is solely responsible for the management of their personal belongings and valuables.

7. Disclaimer

Unless caused by our willful misconduct or gross negligence, Hiwadaya shall not be liable for any damages (including, but not limited to, accidents, theft, or food poisoning) incurred by the Customer during participation in the Services.

8. Prohibited Conduct

The Customer shall not engage in the following acts:

  1. Acts that violate laws or public order and morals.
  2. Acts that infringe upon the honor, reputation, or privacy of our artisans, staff, or other third parties.
  3. Acts that may interfere with the operation of the Services.
  4. Commercial photography, video, or audio recording without our prior permission.

9. Governing Law and Jurisdiction

These Terms and the contract for Services shall be governed by and construed in accordance with the laws of Japan. The Yamaguchi District Court shall be the exclusive court of first instance for any disputes arising out of or in connection with these Terms or the Services.
